Import rules

Monopoly wholesale import structure: all potable liquor entered into Odisha must be consigned to OSBCL wholesale depots. Inter-state and foreign shipments require valid online Import/Transport Passes issued by the Superintendent of Excise. State Excise Adhesive Labels (EAL) / holograms must be affixed to every bottle/SKU prior to retail dispatch. Overseas consignments require certificate of origin, chemical analysis report, bill of entry, and compliance with national FSSAI packaging guidelines.

Import duty on spirits (HS 2208)

150% Basic Customs Duty (BCD) on CIF value for spirits under HS 2208 (structured nationally as 50% Basic Customs Duty + 100% Agriculture Infrastructure and Development Cess / AIDC).

Excise and taxes

Spirits are outside national GST (attracting central GST only on inputs/services). Odisha levies state Excise Duty / Countervailing Duty / Vend Fee (on BIO products) calculated per BL/LPL or specific-plus-ad-valorem basis per excise tariff, followed by Value Added Tax (VAT) under the Odisha VAT Act at 35% on the wholesale issue price, an OSBCL wholesale margin (approx. 1%), fixed retailer margins, and 1% to 2% TCS.

Retail and distribution

Private licensed retailers operate off-premise sales (IMFL 'OFF' shops, Super Premium 'OFF' shops) and on-premise consumption (IMFL 'ON' hotels, restaurants, bars, clubs, beach shacks via OTDC). Operating hours are strictly regulated: 'OFF' shops generally open 10:30 AM to 10:30 PM; 'ON' premises can serve until midnight. Cash memos are mandatory and sales cannot exceed the notified MRP.

Online sale and delivery

restricted

Labelling

Must comply with FSSAI Food Safety and Standards (Alcoholic Beverages) Regulations, 2018 and Odisha Excise Rules. Must state product name, brand name, batch number, date of manufacture/bottling, ABV percentage (% v/v), net quantity, country/state of origin, manufacturer/importer address, and FSSAI logo and licence number. Must include mandatory bilingual health warnings in English and Odia: 'CONSUMPTION OF ALCOHOL IS INJURIOUS TO HEALTH' and 'BE SAFE - DON'T DRINK AND DRIVE'. Official State Excise Adhesive Label (EAL) / holographic seal is mandatory on each pack.

Advertising

Banned. Section 24 of the Odisha Excise Act, 2008 and national Cable Television Networks (Regulation) Act prohibit direct and indirect advertising, hoardings, or promotional sponsorships of liquor. Alcohol brand names cannot be displayed on highway-facing signage or exterior retail boards exceeding excise limits.

Legal definitions of spirits

Regulated under FSSAI Alcoholic Beverages Regulations: distilled spirits (whisky, rum, gin, vodka, brandy) must have a minimum alcoholic strength of 36% ABV (typically bottled at 42.8% ABV / 75° Proof for standard IMFL). Plain neutral spirits/ENA must have minimum 95% ABV.

Dry or restricted areas

Gandhi Jayanti (October 2) and polling/counting days during elections are statutory dry days across the state. No liquor vends are permitted within 500 metres of National and State Highways (pursuant to Supreme Court orders) or near educational institutions, hospitals, places of worship, or designated pilgrimage zones (such as the Grand Road in Puri). Certain tribal scheduled areas have restricted or village-council-regulated permissions for country liquor.

Recent changes

  • Introduction and notification of the multi-year Odisha Excise Policy framework (2024-25 and 2026-29) revising distillery production slabs, consideration money, and brand registration mechanisms.
  • Formal introduction of 'One-Day Temporary ON Licences' allowing the legal serving of liquor at private social functions (weddings, parties) with guest-based tiered fee slabs (₹3,000 to ₹25,000).
  • Enforcement crackdown initiated in mid-to-late 2024 tightening bar closing times (strictly midnight for 'ON' shops, 10:30 PM for 'OFF' shops) and penalizing illegal brand display hoardings.
  • Exemption of BIO (overseas bottled spirits) and high-value IMFL from minimum past sales volume criteria for brand registration, while retaining minimum volume prerequisites (10,000 to 40,000 cases) for mass-market domestic spirits.

Opportunities for exporters

Bottled-in-Origin (BIO) premium spirits benefit from an exemption from domestic interstate sales volume quotas during brand registration in Odisha. Growing urban demand in cities like Bhubaneswar and Cuttack and rapid turnaround on online import passes make OSBCL-routed premium and super-premium spirits an expanding niche.
