Import rules

Spirits imported into Sikkim (both from overseas via customs ports or inter-state) require a valid Import Pass issued by the Excise Commissioner for each consignment; goods must be consigned to a licensed bonded warehouse; intimation must be submitted to the local Excise Officer upon arrival for physical verification, seal inspection, and strength testing prior to release; transport passes are mandatory for any onward movement

Import duty on spirits (HS 2208)

At the national Indian customs border (HS 2208): 150% Basic Customs Duty (levied as 50% Basic Customs Duty + 100% Agriculture Infrastructure and Development Cess [AIDC]). State-level import into Sikkim attracts state import pass fees and countervailing excise levies rather than customs duty

Excise and taxes

State Excise Duty on spirits is levied under Section 23 of the Sikkim Excise Act, 1992, structured by Ex-Factory Price (EFP) brackets; foreign liquor (BIO) imported from outside India is generally exempt from base state excise duty but subject to high Import Pass Fees (Rs. 5,000 to Rs. 9,000+ per case) based on landed value; alcohol for human consumption is excluded from Indian GST and subject to state VAT/surcharges

Retail and distribution

Privately operated retail shops and on-premise venues (hotels, restaurants, bars, clubs) licensed under the Sikkim Excise Rules; licences issued primarily to bona fide state residents; no state-run retail monopoly; retail sales capped at 12 bottles of IMFL/spirits per customer transaction; operating hours fixed by Excise notifications

Online sale and delivery

banned; direct over-the-counter sale at licensed brick-and-mortar retail shops or licensed on-premise service only

Labelling

Must comply with national FSSAI Alcoholic Beverages Regulations (statutory health warning: 'CONSUMPTION OF ALCOHOL IS INJURIOUS TO HEALTH' and 'BE SAFE - DON'T DRINK AND DRIVE', alcohol strength in % ABV, net volume, ingredients, batch number, production date, importer address, FSSAI logo and licence number); state-level requirement: state excise verification marks/holograms and labels stating 'For Sale in Sikkim Only'

Advertising

Strictly restricted; direct commercial advertising of alcoholic beverages is banned across television, radio, print, and public hoardings under the Cable Television Networks Rules and Central Consumer Protection Authority (CCPA) surrogate advertising guidelines; state rules prohibit promotional public signage

Legal definitions of spirits

Spirits must adhere to Food Safety and Standards (Alcoholic Beverages) Regulations, 2018: minimum alcoholic strength of 36% ABV to 42.8% ABV (standard IMFL/whisky/brandy/rum/vodka standard in India is 42.8% ABV / 75° US proof); maximum limits on volatile acids, esters, and heavy metals prescribed under FSSAI

Dry or restricted areas

Sikkim Excise (Prohibited Sites for Liquor Shops) Rules, 1996 prohibit liquor retail outlets within 50 feet of educational institutions, hospitals, and places of worship, as well as within 50 feet of another liquor shop; statutory dry days include national holidays (Republic Day, Independence Day, Gandhi Jayanti), election dry periods, and specific local days notified by the government

Recent changes

  • Promulgation of the Sikkim Excise (Microbrewery/Brewpub) Rules, 2025, providing regulatory frameworks for craft beer production and establishing a strict 21-year service age limit on premises
  • Periodic revisions to import pass fee slabs, Maximum Retail Price (MRP) calculation frameworks, and retail license fees for imported foreign spirits and IMFL
  • Enforcement of strict cross-border dry zone notifications along border towns (e.g., Rangpo, Jorethang, Reshi, Melli) during adjoining regional elections in 2024

Opportunities for exporters

Given Sikkim's flourishing hospitality and tourism sectors, there is steady demand for premium bottled-in-origin (BIO) spirits and wines. Foreign exporters must appoint a qualified, locally licensed Sikkimese distributor to navigate annual brand-label registrations and state import pass clearances.
